COMPETITION NOTICE

1) NAME OF COMPETITION:

Eden Shorts Competition 2015 (the "Competition")

2) METHOD OF ENTRY:

We at Eden are looking for our viewers to produce and submit a high quality video production which is to showcase their wonder at the natural world (each a "Short Film").

In order to enter the Competition, each entrant must upload a Short Film lasting no more than 1 (one) minute to their personal YouTube account. Entrants must then submit the relevant URL for their Short Film together with their personal email address via the Competition entry form application (the "Application") located on the Eden website at eden.uktv.co.uk (the "Website"). Please note UKTV is only accepting entries that are submitted via YouTube and entrants submitting a URL in their Application to other video sharing websites will be disqualified.

3) JUDGING CRITERIA:

Each Short Film is to meet the following judging criteria:

We're looking for an original 1-minute film that displays your wonder of the natural world - our judges will be looking for originality, quality in filming technique and editing, thoughtful communication and relevant subject matter. Any entries received which were previously submitted to UKTV as part of a previous year's Eden Shorts competition will be disqualified from this Competition (the "Judging Criteria").

4) PRIZE:

There will be one (1) prize winner only (the "Winner").

The prize shall consist of:

  • The opportunity to have the Winner's Short Film broadcast on Eden;
  • Camera equipment of value of at least £500.

No alternative prize will be given and the Prize is non-transferable and non-exchangeable. However, UKTV reserves the right to change the Prize due to circumstances beyond its control or to offer an alternative prize of similar value.

The Winner agrees to absolve UKTV from any liability that may result from or is claimed to have resulted from participating in the Competition or from the acceptance or use of the Prize. Nothing in these Terms and Conditions in any way limits the Promoter (or any other person or organisation's) liability for fraud, or death or personal injury caused by negligence.

It is your responsibility to pay any and all applicable taxes which may be due on prizes and to assess whether the prizes are suitable for you and to read and comply with any safety notices or instruction manuals delivered with any prize.

5) SPECIFIC RESTRICTIONS:

All entrants must be over 16 years of age at the date of entry and a legal resident in the UK or Republic of Ireland. Entrants aged under 18 must have obtained the consent of a parent or legal guardian and will provide UKTV with the contact details should we need to verify this.

All entrants must have the internet service or mobile device bill payer's permission prior to entering this Competition.

All entrants must have a YouTube account onto which they can upload their Short Film.

The Short Film may be recorded on any kind of camera device, however if shortlisted the complete Short Film must be submitted to UKTV as a digital file.

If shortlisted, each Short Film will need to be delivered to UKTV as a .mov file, in a 16:9 widescreen ratio and in as high a quality as possible (minimum 720p) with no compression.

If a Short Film shortlisted by the Judging Panel (defined at section 8, below) the entrant will be required to submit to UKTV copies of all consents and/or authorisations from any participants in the Short Film together with location agreements.

UKTV may broadcast those Short Films which are shortlisted by the Judging Panel.

Entrants must have obtained the consent of anyone who features in their Short Film (including the permission of anyone featured in any images used in a Short Film).

If Entrants want to include anyone under the age of 18 (a "Minor") in their Short Film, prior written consent must be obtained from the Minor's parent or legal guardian confirming the parent or legal guardian's consent to the Minor participating in the Short Film. Please note the entrants will be required to provide UKTV with copies of this written consent.

By submitting your Short Film to UKTV you are declaring that it is your own original work, you are the author of it (or have the author's permission to submit it) and you agree to fully indemnify UKTV against any actual or threatened claims or actions UKTV may be subject to in relation to your Short Film.

Download the Music Packs

Entrants are permitted to synch and/or dub the music (which is available for download from the Competition entry page of the Website) to the footage entrants' film for the sole purpose of entering the Short Films commissioned by UKTV to the Competition. Please note, entrants must not incorporate any other music and/or audio tracks into their Short Films except for the music provided on the Website. If entrants do incorporate any other music into their Short Film this will result in their entry not being considered by the Judging Panel. The music available on the Competition entry page of the Website must not be used for any other purpose other than as set out in this paragraph.

Short Films must not contain anything that is obscene, defamatory, indecent, unlawful, disrespectful or offensive. All Short Films must be suitable for broadcast pre-watershed.

UKTV reserves the right to edit all Short Films, at its sole discretion.

Please note that some Short Films may be shown on the Website (at UKTV's sole discretion), however this will not impact on the Judging Panel's decision. All valid entries will be viewed by the Judging Panel.

Entrants must not: (i) use the YouTube AudioSwap functionality to include music within their Short Film; and (ii) use any other functionality or content available through YouTube to edit or amend their Short Film after submission. Please also refrain from enabling the advertising functionality on YouTube in relation to the Short Films as while this will not automatically disqualify entrants Short Films it will mean that they cannot feature on the Website.

6) COPYRIGHT

By entering this Competition all entrants:
A) assign to UKTV all rights (including present and future copyright) in their Short Film in all media (including, without limitation, the internet) and whether in existence now or created in the future;
B) agree not to assert any moral rights in respect of their Competition entry (wherever and whenever such rights are recognised) against UKTV, its assigns, licensees and successors in title;
C) undertake to us that their entry is not in breach of any third party intellectual property rights and will not contain anything, which is defamatory, indecent, harassing or threatening and that they will indemnify us for any loss, damage or liability arising should this turn out not to be true; and
D) confirm that they have the right, power and authority to grant the rights set out above and that they have obtained all consents and permissions necessary to grant us the same.
For the avoidance of doubt, all rights in the name and title of the Competition and the format rights for the Competition are the sole property of UKTV and we may exploit the same in our absolute discretion.

7) COMPETITION PERIOD:

The Competition will be open between 5pm Monday 6th July 2015 and 5pm Wednesday 30th September 2015.

Any entries received outside of the Competition Period (for whatever reason) will be invalid but you may still be charged for the entry where costs apply.

8) WINNER SELECTION:

A panel of judges chosen by UKTV (the "Judging Panel") will compile a shortlist of those Short Films it judges to be the best from all eligible entries received. All shortlisted entrants will then be contacted to submit digital versions of their Short Film via an internet file transfer system or hard copy delivery (such as by DVD or portable hard drive).

The Winner will be selected by the Judging Panel at the end of the Competition Period from the shortlisted entries. Each will be judged according to which best meets the Judging Criteria.

Winner and shortlist selection by UKTV is final and no correspondence will be entered into whatsoever regarding Winner or shortlist selection.

The Winner must claim the Prize by successfully responding to the Promoter's notification by email or telephone within 21 days of the Promoter's first notification being sent.

9) METHOD OF ENTRY & COST:

You can enter this Competition free of charge on the Website as per the process described in section 2 of these terms and conditions. You may need to register yourself, free of charge, on the Website.

10) ENTRY LIMITATIONS:

Only one entry per person is allowed and in the case of multiple entries, only the original entry will be counted.

11) PROMOTER:

This Competition is offered to you by UKTV Media Limited ("UKTV"). Our registered office is at 10 Hammersmith Grove, London W6 7AP and our company registration number is 04266373.

Please note that neither YouTube, Inc. nor Google, Inc. is a sponsor of the Competition, neither are affiliated with the Competition in any way nor have responsibility or liability regarding the conduct or administration of the Competition, which lies solely with UKTV. By entering this Competition you are submitting your details to UKTV and not to YouTube, Inc. or Google, Inc. UKTV is not responsible for content or entries posted by third parties or users of YouTube. 12) PRIZE PROVIDER: UKTV

13) PUBLICITY:

Entry to the Competition gives UKTV the right, without separate consent or compensation, to publicise any Winners' names and counties and to make further use of these in printed publications and on the Internet solely for administering this Competition in accordance with applicable law.

Entrants and in particular the entrants whose Short Films are shortlisted, may be required to participate in photo, recording, video and/or film session(s). In this regard entrants agree that UKTV shall have the right to use all the resulting publicity materials in any medium (including, without limitation, the internet) and in any manner we see fit, unless an entrant advises us at the time of entering the Competition that they wish to remain anonymous. If you elect for anonymity, we may not be able to include you in the Competition.

Entrants also acknowledge that publicity materials featuring them may be provided to our third party prize provider for the purposes of promoting their association with the Competition and awarding the relevant prizes.

No fees shall be payable to any entrant in relation to their entry in any Competition.

14) LAW AND JURISDICTION:

These Terms and Conditions shall be governed by the laws of England and Wales, whose courts shall have exclusive jurisdiction.
